Mohammed bin Rashid Issues Dubai Police Academy Law

His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE, may God protect him, in his capacity as Ruler of the Emirate of Dubai, has issued Law No. (6) of 2026 concerning administrative violations, penalties, and measures in the Emirate of Dubai.

The Law aims to provide a clear and binding legal framework for government entities concerning the administrative violations, administrative penalties, and administrative measures imposed on those who violate the provisions of the legislation in force in the Emirate of Dubai, to enhance the principle of transparency, justice, accountability, and legality, and to establish clear guarantees for imposing administrative penalties and administrative measures that ensure the protection of rights and freedoms and guarantee the continuity of the operation of public facilities, in a manner that achieves the higher interests of society.

The Law also aims to contribute to achieving prompt justice, through governing the controls for imposing administrative penalties and administrative measures in a manner that prevents arbitrariness or abuse in the use of authority, raising the level of awareness of the importance of compliance with the provisions of the legislation in force in the Emirate of Dubai, and achieving general deterrence from committing acts that would threaten the safety of individuals and the security of society.

Controls for Determining Administrative Violations

The Law detailed the controls for determining administrative violations, including that the administrative violation be stipulated by legislation issued by the competent authority, that the administrative violation be described clearly and precisely, such that the addressee of the legislation knows the obligation that they must adhere to and not violate, and that the administrative violation be classified in a manner that makes it easy to determine the degree of its gravity and seriousness to the public interest, whether minor, medium, or grave, which helps in selecting the appropriate administrative penalty.

Controls for Determining Administrative Measures

The Law also set the controls for determining administrative measures in a manner that ensures proportionality, justice, and transparency, whereby the Law stipulated that administrative measures be provided for by legislation issued by the competent authority, that administrative measures be in return for committing an administrative violation stipulated in the legislation, taking into account the gravity and seriousness of the administrative violation and its impact on the public interest, the functioning of public facilities, and the provision of services, and taking into account the mitigating or aggravating circumstances when taking administrative measures, such as repetition, intent, negligence, and default, the damage resulting from the administrative violation, and the early corrective procedures taken by the perpetrator of the administrative violation.

Types of Administrative Measures

Pursuant to the Law, the government entity may take one or more of the following administrative measures against the violator, including: a warning to rectify the situation, whether prior to or subsequent to imposing the administrative penalty; temporary administrative closure of the violating establishments for a period not exceeding (6) six months; permanent administrative closure of the violating establishments; cancellation or amendment of the licenses, permits, or approvals issued to the persons or establishments committing the administrative violations; and the permanent or temporary suspension of all or some of the projects, activities, or transactions of the perpetrator of the administrative violation that have a direct connection to the administrative violation committed.

The Law determined the controls and procedures for imposing, determining, and enforcing administrative penalties and administrative measures, and the procedural guarantees and criteria that the government entity must observe when assessing and imposing administrative penalties or taking administrative measures, and also determined the conditions and controls for publishing and announcing the administrative violation, with the approval of the director general of the government entity and after prior coordination with the Government of Dubai Media Office.

The Chairman of the Executive Council of the Emirate of Dubai shall issue the resolutions necessary to implement the provisions of this Law, including the procedures to be followed for publishing and announcing administrative violations; any provision in any other legislation is repealed to the extent that it conflicts with the provisions of this Law; and it shall be published in the Official Gazette and shall come into effect as of the date of its publication.
