Driving Under the Influence of Alcohol in the UAE: Penalties and License Suspension

Drink driving in the UAE is a criminal offence. Under the Traffic Law it is punished by imprisonment and a fine of AED 20,000 to AED 100,000, or either penalty, plus suspension of the driving licence for at least 3 months on a first offence. Driving under the influence of drugs is heavier: a fine of AED 30,000 to AED 200,000 and a licence suspension of at least 6 months. The law sets no permitted alcohol limit for drivers.

These figures come from Federal Decree-Law No. 14 of 2024 on the Regulation of Traffic, in force since 29 March 2025 and applied in Dubai, Abu Dhabi and every other emirate. The lower fines and the fixed short jail terms still quoted on many websites belong to the old law, which has been repealed.

The risk does not end with the fine. A drunk driving case can mean detention, a prison sentence, loss of your licence, your insurer claiming back what it paid, and deportation if you are a resident. What is the penalty for drink driving in the UAE?

Under the Traffic Law, anyone who drives or attempts to drive a vehicle on the road while under the influence of alcohol faces three consequences:

Imprisonment and a fine

Imprisonment, and a fine of not less than AED 20,000 and not more than AED 100,000, or either of the two. The provision does not fix the length of imprisonment, so the general rule of the Crimes and Penalties Law applies: from one month up to 3 years.

Mandatory licence suspension

The court must suspend the licence for at least 3 months on the first offence and 6 months on the second, and must cancel it on the third. Suspension is not at the judge's discretion; it is part of the judgment.

Attempt is punished like driving

You do not need to have driven any distance. A person caught attempting to drive under the influence of alcohol falls under the same provision.

Every client asks the same question: does drink driving lead to jail? The judge may order imprisonment, may limit the sentence to a fine, or may impose both. What tips the balance is what the file contains: was there an accident, is there a previous conviction, how were the arrest and the test carried out, and what was recorded in the police report. This is exactly where the defence works.

What is the penalty for driving under the influence of drugs?

Driving under the influence of narcotics or psychotropic substances carries a heavier penalty than alcohol: imprisonment and a fine of not less than AED 30,000 and not more than AED 200,000, or either of them, with licence suspension of at least 6 months on the first offence, one year on the second, and cancellation on the third.

What about medicine prescribed by a doctor? The provision covers psychotropic substances and the like, and some sedatives and painkillers are listed in the schedules. A valid prescription may defeat a charge of unlawful use, but it is not enough on its own to defeat a charge of driving under the influence. In the first meeting we therefore ask the client for the prescription, the medical report and the dispensing dates, because the way these papers are put together can change how the charge is classified.

Is there a legal alcohol limit for driving?

No. The Traffic Law sets no permitted blood alcohol level for drivers and draws no line between one glass and ten. It is enough to prove that you were under the influence of alcohol while driving or attempting to drive.

Proof usually rests on the technical test result, the laboratory report, and the arrest report with the traffic officer's notes on your condition. This is the real ground for the defence: was the sample taken by a proper procedure, when was it taken, who wrote the report, and did you actually say what is attributed to you. A single flaw in this chain can change the outcome of the case, and it is found only by someone who reads the file as a criminal lawyer does.

Many people ask whether drunk driving inside a car park is punishable. The law defines the road broadly to include any public place that can take vehicles and that the public may enter, whether for a fee or free of charge. The car park of a mall or hotel will usually fall within it. A closed private place is a question of legal classification examined case by case.

Drunk driving with an accident: injury or death

When driving under the influence of alcohol or drugs is combined with an accident, the case moves to another level:

Death

A person who negligently causes a death while driving under the influence of alcohol or drugs is punished by imprisonment for not less than one year and a fine of not less than AED 100,000, or either, instead of the ordinary penalty for causing death in a road accident.

Injury

The Crimes and Penalties Law increases the penalty for negligent injury where the offender was under the influence of intoxication or drugs at the time of the accident: imprisonment for up to two years and a fine. It rises further where several people are injured.

Leaving the scene

A separate offence punished by imprisonment for up to one year and a fine of AED 50,000 to AED 100,000, or either, added to the above.

Alongside the penalty comes financial liability: diya or arsh, then civil compensation for the remaining losses. Arrest

Arrest and impounding of the vehicle

The law allows traffic officers to arrest a driver caught driving under the influence of alcohol or drugs to the point of losing control of the vehicle, and to impound the vehicle where it is connected to an accident involving an offence. In these hours the firm establishes where the person is being held and contacts the competent authority and the family.

The sample and the technical report

The sample is taken and sent to the laboratory. The test result is the backbone of the charge, and reviewing how it was obtained is the first thing the defence does.

Trial

Traffic court and appeal

The case is referred to the competent court. This is where the defence memorandum, pleas for leniency and supporting documents are filed. If the judgment is unfavourable, the time limit for appeal is short and is lost by delay.

Driving licence suspension: how long, and what comes next

The suspension period for drunk driving starts from the mandatory minimum above, but the judgment may go further. On conviction for any driving offence the court may suspend the licence for up to 3 years, and may bar the driver from obtaining a new licence for a further period of up to two years after the suspended licence expires.

Anyone who drives during the suspension commits a new offence punished by imprisonment for up to 3 months and a fine of not less than AED 10,000, or either. In addition to the judgment there are administrative sanctions such as traffic points and vehicle impound, set by the executive regulations and the decisions issued under the law.

A person barred from obtaining a driving licence may apply to the court that convicted them to cancel the bar once 6 months have passed from the date of conviction. That application needs drafting, grounds and documents, and we handle it for those whose work or livelihood has been disrupted by the bar.

Consequences drivers do not expect

The insurer can claim against you

The insurer compensates the injured third party, but the unified third-party liability policy allows it to recover what it paid from the insured or the driver if it is proved that the accident was committed under the influence of drugs or alcohol, or of medicines after which driving is not medically permitted. With a rented car, recovery is against the renter who was driving. Damage to your own vehicle is excluded under the loss and damage policy. You may find yourself facing a large claim after the criminal case is over.

Deportation for residents

In an alcohol case deportation is discretionary: the Crimes and Penalties Law allows the court to deport a foreigner sentenced to a custodial penalty in a misdemeanour, or to order deportation instead of that penalty. In a drug case the position is stricter: since 1 January 2026 the law on combating narcotics requires the deportation of a foreigner convicted of any of its offences, including drug use, with exceptions only for the spouse or first-degree relative of a UAE national, and for a person whose deportation the court finds would cause serious harm to their family residing in the UAE. Work and record

A professional driver loses their income when the licence is suspended, and the traffic regulations require, for taxi and bus driving permits, that the driver has not been caught or convicted of driving under the influence of alcohol or drugs. Drink driving penalty in Dubai and Abu Dhabi: is it different?

Not in the text. The Traffic Law is federal, and the penalty for drink driving in Dubai is the same as in Abu Dhabi, Sharjah and the other emirates. What differs is the authority that handles the file, its procedures, and how its courts tend to weigh a fine against imprisonment. Ask for your lawyer before you speak

What is written in the police and prosecution reports stays with you to the last level of appeal. Do not sign statements you have not read or understood, and ask to contact a lawyer.

Do not drive during the suspension

Being caught driving with a suspended licence opens a second case and weakens your position in the first.

Do not negotiate with the injured party or the insurer alone

A single written or recorded admission can be used against you in the civil claim and in the recovery claim. Let the firm manage and document the settlement.
