Filing a report with Abu Dhabi Police does not mean a criminal case exists. A report is a notification of an incident. It becomes a criminal case when the police complete their inquiry record and refer the file to the Public Prosecution, and the prosecution then finds that the incident is a crime supported by sufficient evidence and refers it to the criminal court. Before that point, a report may be archived without ever reaching a judge.
The danger in filing a criminal report in Abu Dhabi lies in how it is filed. A report about a civil matter is archived and the time is lost. A request submitted through the wrong door comes back to its owner. Inaccurate statements in the police record count against the person who made them up to the last level of appeal, and a report built on untrue facts can turn the reporter into the accused.
This article explains when a report with Abu Dhabi Police becomes a criminal case, when the prosecution's permission is needed before a report can be opened, and what the firm handles for you at each stage, from drafting the report to judgment. It is part of the firm's articles on criminal cases.

When does a report with Abu Dhabi Police become a criminal case?
A report passes through four stations, and at each one it may stop or continue:
Report
Filing and registering the report
The reporter's statement is recorded and the report is given a number. That statement is the foundation of the whole file, and what is written in it is hard to change later.
Inquiry
Evidence gathering by the police
The police hear the complainant and witnesses, examine documents and correspondence, and summon the other party to give a statement. This is where the difference shows between a report supported by ordered evidence and one written in a hurry.
Prosecution
Referral to the Public Prosecution
The record is referred to the Public Prosecution in Abu Dhabi, which investigates and questions the accused, then decides: either the incident is a crime supported by sufficient evidence, or the papers are archived or an order is issued that there are no grounds to bring a case.
Court
Referral to the criminal court
If the prosecution refers the file to court, the report becomes a criminal case in the full sense: an accused, a charge, hearings and a judgment. The victim may join the case as a civil claimant to claim what is owed.
The full stages, from the report to what follows the judgment, are in Criminal Cases in the UAE.
How do I file a report with Abu Dhabi Police?
A criminal report in Abu Dhabi is filed in person at the police station in whose area the crime took place, or remotely through the criminal report request service on Abu Dhabi Police's smart channels, or through the Ministry of Interior's service for filing criminal reports. A lawyer may also file it under a power of attorney on behalf of the person concerned.
The channel is the easy part. What decides the fate of a report is its content: the correct legal description of the incident, the order of the facts, and the evidence attached to each fact. For those defrauded when buying through social media, there is a dedicated article: I Was Scammed on Instagram or TikTok: How Do I File a Report?
The prosecution petition: when is permission needed to open a report in Abu Dhabi?
Not every report in Abu Dhabi starts at the police station. In certain incidents the route begins with a request for permission to open a report, submitted to the Public Prosecution through the Abu Dhabi Judicial Department. People know it as the prosecution petition. If the prosecution approves, the request is referred to the police to open the report and investigate the incident. If it refuses, the criminal route stops there.
The petition is not a form to be filled in. It is a written memorandum that explains the incident and why it amounts to a crime, with the documents attached, and the prosecution decides on that basis. Those who look for a ready-made prosecution petition template to copy usually submit a general request that does not show the elements of the crime, and it is refused. That is why the firm drafts the petition on the facts and documents of each file, and first determines which door the report should go through: the police directly or the prosecution's permission.
What is a criminal report, and when is the matter civil?
A criminal report concerns an act punishable by law: theft, fraud, breach of trust, assault, threats, insult and defamation, forgery, or a cybercrime. A dispute over a debt, a contract, a partnership or defective goods is in principle a civil or commercial dispute, and its place is the civil court, not the police station.
The line between the two is fine. Someone who lent money and did not get it back has a civil debt. Someone who handed over money in trust and saw the recipient take it for himself has a crime. A mistake in this classification is the first reason reports are archived and petitions refused, as explained in Converting a Criminal Report to a Civil Dispute: When Does the Prosecution Archive the Report?
Your statement in the police record: the most critical part of the report
Many people think the record is a formality and that the details can be explained later in court. In reality the court reads what was said on the first day and compares it with what is said afterwards, and any contradiction between the two accounts weakens the whole report.
The recurring mistakes are stating an approximate amount and changing it later, attributing acts to a person without evidence, leaving out a fact that seems unimportant and turns out to be an element of the crime, and signing a record without reading it. This is why the lawyer attends with the client when the statement is taken, a right explained in Can a Lawyer Attend Interrogation with the Accused or Victim?

We represent you before the criminal court and claim return of the money and compensation, so that the judgment does not end with punishing the offender while your right is not returned.
What is the penalty for a false report in the UAE?
Anyone who reports to the authorities, falsely and in bad faith, a crime he knows did not take place, or attributes it to a person he knows to be innocent, is punishable under the Crimes and Penalties Law by imprisonment and a fine, or by one of the two. The penalty is heavier depending on the seriousness of what was attributed to the person and on what resulted from the report. The person harmed may also claim compensation, as set out in Malicious Reporting in the UAE: How to Claim Compensation?
This does not mean that every archived report is a false report. A truthful report whose evidence was not sufficient is one thing, and a fabricated report is another. But exaggerating the facts or accusing a person without evidence brings the reporter close to that risk, and a legal review of the report before it is filed protects you from it.
Mistakes that cost the reporter his right in Abu Dhabi
Using the report as pressure in a money dispute
Filing a criminal report to force the other side to pay in a civil dispute usually ends in archiving, and may turn against the person who filed it.
Naming and shaming the person complained of
Publishing his name, photo or the details of the report on social media may expose you to liability. The place for an accusation is the report, not a post.
Delay in filing the complaint
In some crimes the case can only be brought on a complaint by the victim within a set period, and missing it extinguishes the right to complain.
Legal time limits on the path of a criminal report
3 months
to file the complaint in crimes that depend on the victim's complaint, from the day he learns of the crime and its perpetrator
48 hours
the period within which the police send an arrested person to the Public Prosecution
10 days
to file a grievance against a no-grounds order, from the date it is notified
These time limits are affected by the type of crime and the circumstances of each file. Calculating them precisely is the lawyer's work when studying the documents.
How do I check the status of a report with Abu Dhabi Police?
A report is tracked by its number through the smart channels of Abu Dhabi Police and the Ministry of Interior while it is with the police, and through the services of the Abu Dhabi Judicial Department after it has been referred to the prosecution. The enquiry only tells you which stage the file has reached. It does not tell you why it stopped or what is needed to move it. That is what the firm follows up, through visits and written applications.
If you are on the other side and a report has been filed against you, the course of action is completely different. We explained it, using Dubai as the example, in What to Do If a Complaint Is Filed Against You at Dubai Police?
Practical tips before filing a police report
Save the evidence before anything else
Correspondence, transfers, contracts and recordings. Do not delete anything and do not confront the other party before documenting what you have.
Write the facts with their dates
A short chronological summary without interpretation or emotion. The timeline shows where the file is strong and where it is weak.
Show the file to a lawyer before filing, not after archiving
Correcting a report filed wrongly, or a petition that was refused, is far harder than drafting it properly the first time.

Frequently asked questions about filing a report with Abu Dhabi Police
QHow do I file a report with Abu Dhabi Police?
In person at the competent police station, through the criminal report request service on Abu Dhabi Police's smart channels, through the Ministry of Interior's service, or through a lawyer under a power of attorney. In certain incidents the prosecution's permission is needed first, by petition.
QHow can I register a criminal report?
The report is registered by recording your statement and attaching your evidence with the police. It is given a number and evidence gathering begins. More important than registration is that the report is written with the correct legal description and ordered facts.
QWhen does a report become a criminal case?
When the police refer it to the Public Prosecution, and the prosecution then finds that the incident is a crime supported by sufficient evidence and refers it to the criminal court. Before that the report may be archived.
QWhat is a prosecution petition to open a report?
A written request submitted to the Public Prosecution for permission to open a report with the police about a specific incident. It explains the incident and its grounds, with the documents attached. If the prosecution approves, it is referred to the police.
QIs there a ready-made template for a criminal report request?
The templates in circulation are general and do not suit every incident. Acceptance depends on showing the elements of the crime in your own incident, which is why the petition is drafted on the documents of each file.
QWhat is the penalty for a false report in the UAE?
Imprisonment and a fine, or one of the two, for anyone who reports falsely and in bad faith. The penalty is heavier depending on what resulted from the report, and the person harmed has a right to compensation.
QHow can I check a report with Abu Dhabi Police?
By the report number through the smart channels of Abu Dhabi Police and the Ministry of Interior, then through the services of the Judicial Department after referral. The firm handles the actual follow-up and submits the applications needed to move the file.
QCan I withdraw the report after filing it?
In crimes that depend on the victim's complaint, a waiver ends the case. In others the prosecution continues with the case because it concerns the public right, although the waiver may affect the penalty.
QWhat do I do if the report is archived or the petition refused?
That is not always the end of the road. There is a grievance with a time limit, and there is the civil route for claiming the right. The lawyer determines which is more useful after seeing the reason for the decision.
QDo I need a lawyer to file a report with Abu Dhabi Police?
The police accept the report from you directly, but the result depends on classification, drafting, choosing the right door, follow-up, a grievance filed on time and the civil claim. Their absence is why most rights are lost.
