If you need a good conduct certificate in the UAE and you have a previous police report, a pending case or a judgment against you, the direct answer is this: a report alone does not make you a person with a criminal record; a case in which no final judgment has been issued is not recorded as a precedent; but a final conviction for a felony or a misdemeanour remains on the record until you obtain rehabilitation. Between those two ends there are many situations that never count as a precedent at all: a penal order, a criminal settlement in misdemeanours, a suspended sentence whose probation period passed without incident, and contraventions.
Its official name at the Ministry of Interior, Dubai Police and Abu Dhabi Police is the "Police Clearance Certificate" (criminal status search certificate), but most people search for it as a good conduct certificate, and it is one and the same document. What matters is to tell it apart from the criminal record that the authorities consult: the certificate is what reaches you; the record is what the decision to issue it is based on.
In this article a criminal lawyer in Dubai from AWADH ALMHEIRI LAW FIRM AND LEGAL CONSULTATIONS explains what actually appears in a good conduct certificate, when it is refused, how a record is cleared, and what to do if your application is rejected because of an old case or judgment.

What is the good conduct certificate, who issues it and why is it required?
The good conduct certificate is an official document issued by the Ministry of Interior through the police, stating whether or not its holder has criminal precedents recorded in the State. It is usually required for employment in the public and private sectors, professional licences, certain types of residence permits and visas, sensitive professions such as education, healthcare and security, and sometimes for emigration or study abroad.
What many people do not know is that the certificate does not reflect everything you have ever had with the police; it reflects what has settled in the record as a judicial precedent. So the right question is not "do I have a case?" but "has a final conviction for a felony or misdemeanour been issued against me without my having obtained rehabilitation?". That is the criterion on which the certificate is built.
Good conduct certificate, police clearance certificate or criminal record?
Three names circulate around this subject: two of them refer to one thing, and the third to something entirely different.
Police Clearance Certificate (criminal status search certificate)
This is the official name of the document in the services of the Ministry of Interior and Dubai Police; Abu Dhabi Police describes it as the criminal status certificate, and Ras Al Khaimah Police calls it the good conduct certificate - criminal status search. It is issued to the applicant personally, for the period of their residence or visit in the State, to be presented to the requesting entity, and it is attested by the Ministry of Foreign Affairs when it is for use outside the State.
Good conduct certificate
This is the name used by the public and by requesting entities for jobs, licences and immigration, and it is the very same document. If you are asked for a good conduct certificate, what is meant is the police clearance certificate; there is no separate document under this name.
Criminal record (record of precedents)
The criminal record, or record of precedents, is the internal register kept by the Ministry of Interior in which final criminal judgments are entered, and which judicial and security authorities consult directly. It is not a document handed to individuals; what reaches you is the certificate issued on its basis. That is why clearing the effect of a judgment from this register through rehabilitation is what changes the outcome of the certificate, not the other way round.
The practical conclusion: when your certificate is refused or put on hold, the question is not about the certificate but about the entry behind it, and that is the first thing a lawyer looks into.
I have a report or a case that has not yet been decided: will it appear in the certificate?
As a rule, a report filed against you at the police, or a case pending before the Public Prosecution or the court, is not a criminal precedent; the accused is innocent until proven guilty by a final judgment. So the mere fact that a police report was filed against you or that you were referred to the Public Prosecution is not recorded against you as a precedent, and if the report is closed or an acquittal is issued it leaves no trace in the certificate.
In practice, however, the issuance of the certificate may be delayed or the application suspended if there is an ongoing criminal case in your name or an outstanding arrest order, because the issuing authority enquires into the criminal status as a whole. The solution here is to close the pending file first: either by having it dismissed, by obtaining a judgment in it, or by ending it through conciliation or criminal settlement in the offences where the law allows it. And if you are summoned for questioning, you have the right to have a lawyer present with you from the very first moment.
A judgment was issued against me: what appears and what does not?
A final conviction for a felony or a misdemeanour is what constitutes a judicial precedent appearing in the good conduct certificate, whether the penalty was imprisonment or a fine, and whether or not it was executed. However, UAE law expressly removes a number of situations from the circle of precedents, and these are the ones most of our clients ask about:
The penal order
Under the Criminal Procedure Law, a penalty imposed by a penal order issued by the Public Prosecution is not deemed a judicial precedent requiring rehabilitation. If your case ended with a penal order imposing a fine and was not referred to court, the rule is that it does not appear as a precedent.
Criminal settlement in misdemeanours
Likewise, the law provides that a penalty imposed under a criminal settlement in misdemeanours is not deemed a judicial precedent requiring rehabilitation. This is what makes settlement a smart option in many minor misdemeanours, instead of waiting for a conviction that stays on the record.
A suspended sentence
If the court sentenced you to imprisonment with suspension of execution, the suspension period under the Crimes and Penalties Law is 3 years from the day the judgment becomes final. If it passes without any ground arising for the suspension to be revoked, the judgment is deemed as if it had never been issued. Before it passes, the judgment stands and its effect remains.
Contraventions and bounced cheques
Contraventions are not precedents that block the certificate. And a cheque returned for insufficient funds is no longer an offence in itself; it has become an executive instrument enforced directly, as we explained in the article
what to do if a cheque in your name bounces in the UAE; it remains criminal only in specific forms such as bad faith or forgery.
Conversely, a sentence to a penalty alternative to imprisonment, such as community service or electronic monitoring, is a conviction like any other even though its effects are lighter; see the article on alternatives to imprisonment in misdemeanour cases. And a judgment that includes judicial deportation carries a separate additional effect, which we explained in the article on lifting judicial deportation after completing the sentence.
A judgment in absentia or an unexecuted judgment: does the precedent appear?
Many residents are surprised, when applying for the certificate, to find a judgment they never knew about, because it was issued in absentia. Here a distinction must be made: a non-final judgment in absentia in misdemeanours does not settle as a precedent until the time limits for challenge have expired, so the first thing a lawyer does is check the date on which you were notified of the judgment and whether the door to opposition or appeal against the judgment in absentia is still open. In many cases the challenge succeeds and the judgment is set aside, and the precedent is erased at its source.
If, on the other hand, the judgment is final but has not yet been executed, non-execution does not erase the precedent; it complicates matters, because the enforcement order may remain in place and may give rise to a travel ban or a restriction on transactions. And the lapse of the penalty by prescription, which under the Criminal Procedure Law is 7 years in misdemeanours and 30 years in felonies from the date the judgment became final, does not by itself extinguish the precedent; it only extinguishes execution of the penalty, and rehabilitation remains the way to clear the effect of the judgment.
Rehabilitation: how is a precedent cleared from the certificate?
Rehabilitation is the legal procedure that erases the criminal effects of a final conviction, so that the precedent no longer appears in the good conduct certificate. It is of two kinds: legal rehabilitation, which takes effect by operation of law after the prescribed period has passed without a new offence, and judicial rehabilitation, which is requested from the court after a shorter period, if its conditions are met.
Its practical conditions revolve around three things: that the penalty has been executed, has lapsed by prescription or has been pardoned; that the waiting period prescribed by law has passed since that date, and it differs between felonies and misdemeanours; and that the convicted person has settled the financial obligations imposed by the judgment and conducted themselves well during the period. We explained the procedures, the periods and the offences that require it in detail in the article on judicial rehabilitation in the UAE.
Our practical advice: do not wait until you need the certificate to start the rehabilitation file. The application takes time and requires a certificate of execution of the penalty and payment of fines and compensation, and those who start early are ready when a job opportunity or a licence comes their way.
My application was refused or a precedent appeared in it: what do I do?
The first step is to know the exact reason for the refusal: is it a standing final judgment, a pending case, an old arrest order that was never cancelled, or an error in matching the name or data. The criminal status can be enquired about through the official channels of the police in the relevant emirate, after which the lawyer determines the appropriate path:
Verification
Extract the details of the recorded entry: the case number, the court, the date of the judgment and the status of execution.
Challenge
If the judgment was issued in absentia or is still open to challenge, the challenge is filed immediately to have it set aside at the source.
Settlement
If the case is pending, the file is closed through conciliation, criminal settlement or a judgment in it.
Execution
If the judgment is final, the penalty is executed and the fines are paid so that the rehabilitation period can begin.
Rehabilitation
After the period has passed, the application for judicial rehabilitation is filed and the certificate is then requested anew.
If the refusal is linked to a travel restriction or an old enforcement order, see also the article on lifting a travel ban in the UAE and the cases in which it lapses. In all cases, engaging a criminal lawyer from the outset, as we explained in the article accused of a crime in the UAE, is the surest way to avoid a precedent that could have been avoided by a settlement or a proper defence.
Periods you need to know
3 years
Suspension period
Runs from the date the judgment becomes final; once it passes without revocation, the judgment is deemed as if never issued
7 years
Lapse of a misdemeanour penalty
From the date the judgment becomes final; it does not by itself erase the precedent
30 years
Lapse of a felony penalty
Except in crimes of retribution, blood money, the death penalty and life imprisonment
Practical tips before applying for the certificate
Check your status first
Do not apply for the certificate without knowing what is recorded in your name; enquire about your criminal status before applying so the application is not refused and the refusal documented.
Keep the closing documents
The dismissal decision, the acquittal, the settlement record, the certificate of execution of the penalty and payment of the fine: all of these settle the matter at any enquiry.
Do not assume the old case is over
A judgment in absentia and an old arrest order surface after years; check them before any procedure that requires the certificate.
Start rehabilitation early
The file cannot begin until the penalty has been executed and the financial obligations paid, so every day of delay in payment delays the clearing of the precedent.

Frequently asked questions about the good conduct certificate in the UAE
QDoes a dismissed report appear in the good conduct certificate?
No. A report dismissed by the Public Prosecution or the police is neither a judgment nor a precedent, and it does not appear in the certificate. If it was referred to court and an acquittal was issued, it likewise leaves no trace.
QIs the police clearance certificate the same as the good conduct certificate?
Yes, it is one document. Police clearance certificate (criminal status search certificate) is the official name at the Ministry of Interior, Dubai Police and Abu Dhabi Police, while good conduct certificate is the common name used by requesting entities. The criminal record, by contrast, is the internal register on which the certificate is based, and it is not handed to individuals.
QI have a case pending in court with no judgment yet; will I get the certificate?
A pending case is not a precedent, but in practice the application may be delayed or suspended until it is decided. It is best to close the file with a judgment or a settlement and then apply.
QIs a judgment imposing only a fine a precedent?
If it was issued by the court as a conviction in a misdemeanour, it is a precedent that appears until you are rehabilitated. If the fine was imposed by a penal order of the Public Prosecution or by a criminal settlement in a misdemeanour, it is not a precedent by express provision of the law.
QI was sentenced to imprisonment with suspension; does the precedent appear?
During the suspension period, which is 3 years from the finality of the judgment, the judgment stands. Once it passes without revocation of the suspension, the judgment is deemed as if never issued and its effect does not appear.
QDoes a bounced cheque prevent me from obtaining the certificate?
A cheque returned for insufficient funds is no longer an offence; it is an executive instrument claimed through civil enforcement, so it is not recorded as a precedent. Specific forms remain criminal, such as withdrawing the funds in bad faith or forgery.
QHow long until the precedent is cleared from the record?
It varies according to the type of offence and the type of rehabilitation: legal rehabilitation takes effect automatically after a longer period, while judicial rehabilitation is requested from the court after a shorter period running from execution or lapse of the penalty, provided the financial obligations have been settled and conduct has been good.
QCan I obtain the certificate before rehabilitation?
You can apply, but the certificate will reflect the existence of the precedent or the application will be refused, depending on the requesting entity. It is therefore preferable to complete rehabilitation first if the certificate is needed for a job or a licence.
QA judgment in absentia was issued against me that I knew nothing about; what do I do?
Check immediately the date on which you were notified of the judgment; if the time limits for opposition or appeal are still running, the challenge sets the judgment aside from its root. If it is final, the route is execution and then rehabilitation.
QDo precedents issued outside the UAE appear in the UAE certificate?
The UAE certificate reflects the local record within the State. Foreign judgments have their own special rules and are not entered automatically; it is advisable to consult a lawyer if the requesting entity asks about the record in more than one country.
QDo I need a lawyer to obtain a good conduct certificate?
In the ordinary case, no. But if you have a report, a case or a previous judgment, it is the lawyer who determines whether the entry is a real precedent and chooses between challenge, settlement or rehabilitation to deal with it.
