New Regulations for Private Companies in Dubai's Judicial Execution

Dr. Saif Ghanem Al Suwaidi, Acting Head of Dubai Courts for Administrative Affairs, issuedDecision No. (2) of 2026 regarding the operational system for private companies in judicial execution procedures in Dubai, dated January 23, 2026, allowing Dubai Courts to outsource certain execution procedures to licensed private entities under the supervision of the competent execution judge and the execution department.


Outsourcing System

The decision permits Dubai Courts to enter into contracts with licensed private companies and offices to undertake execution procedures, specifying the rights and obligations of each party, the financial compensation, the duration of outsourcing, the termination mechanism, and the penalties for breach. The decision requires prior coordination with the Finance Department before entering into any outsourcing contract.

What is outsourcing?

The decision allows Dubai Courts to enter into contracts with licensed private companies and offices to undertake some judicial execution procedures, while maintaining full supervision by the competent judge and the execution department. The contract specifies the rights and obligations of both parties, the financial compensation, the duration of outsourcing, the termination mechanism, and the penalties for breaching obligations.

Conditions for the Executor

The decision specifies the conditions required for the individual responsible for carrying out execution procedures at the entity:

  • A Bachelor's degree in law with at least 3 years of experience, or a Master's degree in law with at least 2 years of experience.
  • Good conduct and behavior and not having a prior conviction for a felony or a crime that undermines honor or integrity.
  • Complete medical fitness.
  • Passing the training program accredited by the courts.
  • Residence visa sponsored by the establishment for non-citizens.
The establishment must present the appointment request for the executor to the execution department to verify that all stipulated conditions are met before hiring.

Key obligations of the executor

  • Performing tasks with neutrality and integrity according to the procedures and rules stipulated in the decree law.
  • Maintaining the confidentiality of information, data, and documents accessed.
  • Notifying the execution department immediately of any violation, obstacle, or error that occurs during execution.
  • Full cooperation with the execution department in supervision, follow-up, and evaluation tasks.
  • Exhibiting honesty and professionalism and avoiding any actions that could harm the reputation of the courts.

Prohibitions on the executor

  • Directly initiating execution procedures related to himself, his spouse, or his relatives or in-laws up to the fourth degree.
  • Exercising any form of pressure, exploitation, or threats during execution procedures.
  • Using the courts' emblem or claiming to be an employee of the Dubai government or the courts for personal gain.
  • Announcing or making statements through media regarding execution procedures.
  • Disclosing information about seized funds or assets to non-parties of the execution file or legally authorized entities.

Supervision and oversight

The execution department is responsible for the full supervision of the works of the establishment and the executor, by reviewing the records, documents, and execution files, summoning the executor to provide information on any incident, and receiving complaints from interested parties and addressing them. Reports are prepared on the violations and presented to the competent judge for necessary action. The establishment is also obligated to submit periodic reports to the execution department that include a statement of execution files, amounts collected, areas of expenditure, and obstacles faced.
