How to File a Case in Abu Dhabi?
How do I file a case in Abu Dhabi? The direct answer: the path starts with the type of dispute, not with the filing system. A lawsuit in Abu Dhabi is filed electronically through the Abu Dhabi Judicial Department, but before filing you must know where your dispute begins: a criminal matter starts with a report to Abu Dhabi Police, a labour dispute with a complaint to the Ministry of Human Resources and Emiratisation, a rental claim is registered only with a lease attested by the Municipality, many civil and commercial disputes go to mediation and conciliation, and a debt proven in writing has a faster route called a payment order.
Abu Dhabi has its own independent local judiciary with its own rules: its courts report to the Judicial Department, not the Ministry of Justice; it has a dedicated Civil Family Court for non-Muslims; the Abu Dhabi Global Market Courts run on an entirely different system; and a claimant must translate the statement of claim into English when the defendant does not speak Arabic. A mistake on any of these points ends with the claim being declared inadmissible or outside the court’s jurisdiction, with fees and time lost.
In this article, AWADH ALMHEIRI LAW FIRM AND LEGAL CONSULTATIONS, registered in Abu Dhabi and with the Ministry of Justice, explains the correct path for filing each type of case and lawsuit in Abu Dhabi, what happens after registration, and where the mistakes lie that lose a claim before it even begins.
Before You File a Case or Lawsuit in Abu Dhabi: What Type of Dispute Is It?
Every dispute in Abu Dhabi has a body where it starts, and starting at the wrong one sends you back to square one:
Criminal
Detention, fraud, assault, drugs or a cheque
It starts with a report at a police station, which is referred to the Abu Dhabi Public Prosecution, the authority that brings the criminal case. Details in Filing a Report with Abu Dhabi Police: When Does It Become a Criminal Case?.
Labour
Dismissal, unpaid salaries or end-of-service dues
It starts with a complaint to the Ministry of Human Resources and Emiratisation, and a claim is registered before the Abu Dhabi Labour Court only on the Ministry’s referral. See Labor Issues in the UAE.
Rental
A dispute between landlord and tenant
Heard by the Rental Disputes Settlement Committees, and the condition for filing is a lease attested by the Municipality.
Personal status
Divorce, custody, maintenance or inheritance
Heard by the Family Court, and many of these claims pass through family guidance before filing; for non-Muslims there is the Abu Dhabi Civil Family Court.
Real estate and construction
Developer delay or a dispute with a contractor
The outcome depends on the contract and any penalty or arbitration clause in it, and Abu Dhabi has a centre dedicated to settling real estate disputes amicably.
Compensation
Traffic accident or medical error
Accident compensation is usually tied to the traffic case and the insurer, while a medical error normally goes before the medical liability committee before any claim.
Administrative
A government decision or administrative deportation
It has short grievance and appeal deadlines whose expiry forfeits the right, and administrative deportation differs from deportation by court judgment, each with its own route.
Civil and commercial
A debt, a contract or a partnership
This is what most people searching for how to file a lawsuit in Abu Dhabi mean, and it is covered in the rest of this article.
Mediation and Conciliation Before Filing a Lawsuit in the Abu Dhabi Courts
The Abu Dhabi Judicial Department aims to settle civil and commercial disputes amicably before judgment. It runs mediation and conciliation centres and keeps a register of accredited private mediators, and in 2026 it accredited the first group of conciliators at the mediation centre of the Abu Dhabi Chamber of Commerce and Industry for commercial disputes. A real estate dispute settlement centre has also been set up in cooperation with the Department of Municipalities and Transport.
The risk here is twofold: some disputes are inadmissible if filed without going through conciliation where it is required, and an approved settlement carries the force of an enforceable instrument, so there is no going back on it even if a party gave up more than it should have.
A Debt Proven in Writing? A Payment Order in Abu Dhabi Is Faster Than a Lawsuit
If your right is a sum of money that is fixed, due and proven in writing, such as a cheque, contract, acknowledgement or accepted invoice, the federal Civil Procedure Law, which the Abu Dhabi courts apply, lets you request a payment order electronically through the Judicial Department’s services instead of filing a full lawsuit. It is preceded by a demand giving the debtor at least five days to pay, and the order is then issued within three working days of the application. An incomplete application is transferred to the ordinary procedure and loses its speed. Details in How to Collect Your Debt via Order of Performance in UAE
Rental Claims in Abu Dhabi: An Unattested Lease Stops Your Case
One of the things that most surprises landlords and tenants is that a rental claim in Abu Dhabi is registered only if the lease is attached and its registration with the Municipality is verified, under the decision regulating the Rental Disputes Settlement Committees and their procedures. Anyone whose lease is not attested must attest it before any claim. An eviction claim for demolition is registered only with the demolition permit, a certificate of the building’s age and other documents.
On the other hand, a lease registered with the Municipality is an enforceable instrument for claiming overdue rent, which may spare the landlord a full lawsuit. See Rental Disputes in the UAE.
Your Opponent Doesn’t Speak Arabic? English Translation in the Abu Dhabi Courts
The language of the Abu Dhabi courts is Arabic, but since November 2018 the Judicial Department has required claimants in civil and commercial cases against a defendant who does not speak Arabic to translate the statement of claim and its documents into English. This does not apply to labour and criminal cases. Neglecting the translation blocks service and delays the case from the very first step.
And if you are a non-Arabic speaker and a case has been filed against you, the translation helps you understand, but the judge rules on the Arabic text, and it is the lawyer who answers it within the deadlines.
Abu Dhabi Civil Family Court: Cases for Non-Muslims
Abu Dhabi is distinguished by a Civil Family Court that hears civil marriage, divorce, custody and estate cases for non-Muslims under the Law on Civil Marriage and Its Effects in the Emirate of Abu Dhabi. The common mistake is filing before a court that lacks jurisdiction, or confusing what falls under this law with what falls under another law depending on the parties’ religion and the place of marriage. Details in Civil Divorce for Non-Muslims in the UAE.
Abu Dhabi Courts or ADGM Courts?
The Abu Dhabi Global Market Courts are independent courts that operate in English under the common law, hearing disputes connected with ADGM or its companies, or those whose parties have agreed to their jurisdiction. If your opponent is a company registered in ADGM or the contract refers to its courts, the Abu Dhabi courts may not have jurisdiction at all. Details in Issues of the Dubai International Financial Centre and Abu Dhabi Global Market.
Filing a Lawsuit in Abu Dhabi Online Through the Judicial Department: What Happens After Registration?
A case in Abu Dhabi is registered through the Judicial Department’s electronic portal or app using UAE Pass, by submitting the statement of claim and its documents, attaching any required referral such as the Ministry of Human Resources referral in labour cases, and then paying the fees. The Civil Procedure Law gives the claimant three working days to pay after being notified, otherwise the registration is deemed void.
The statement of claim must contain full details of the claimant and the defendant, the court it is filed before, and the requests and their grounds. An error in the opponent’s details can delay service for months, and the court will not award more than an incomplete request asks for. The competent court is in principle the court of the defendant’s domicile; if the defendant is in Al Ain, the case goes before its courts, as explained in Lawyer in Al Ain: Representation Before Al Ain Courts and Abu Dhabi Judicial Department.
After registration most cases begin with a session before the Case Management Office, where the defendant is served, memoranda are exchanged, settlement is proposed and an expert may be appointed, before the case is referred to the competent circuit. At this stage the right to raise some procedural defences is lost if they are not raised in time, and judgment may be issued in the absence of anyone who does not follow electronic notifications.
Why Is a Lawsuit Not Accepted in Abu Dhabi? Mistakes That Lose a Case Before It Starts
Many claims are lost not because the claimant has no right, but because they were filed the wrong way, so the court rules them inadmissible without examining the right itself:
Jurisdiction
The wrong body or court
A rental dispute filed in court instead of the rental committee, a civil family case before a court without jurisdiction, a dispute within the jurisdiction of the ADGM Courts, or a contract with an arbitration clause that the opponent invokes in its first defence.
Precondition
Missing referral, attestation or conciliation
A labour claim without the Ministry’s referral, a rental claim with an unattested lease, a dispute that had to go to conciliation first, or a medical error compensation claim without the competent committee’s report.
Standing
The wrong defendant or the wrong claimant
Suing the company’s manager when the debt is owed by the company, or the company when the obligation is personal; a claim against a party without standing is not accepted however clear the right is.
Limitation
A right lost with the passage of time
Every right has a period after which it lapses if the opponent invokes it, and delay can make the strongest documents worthless.
What Are the Abu Dhabi Court Fees?
Judicial fees in Abu Dhabi are governed by the emirate’s own laws, and in monetary claims they are proportional to the value of the claim. One of their rules is that requests arising from different legal causes are each assessed separately, up to a maximum of forty thousand dirhams per request. Some claims, such as workers’ claims, are exempt from fees within the limits set by law. A mistake in valuing the claim blocks registration or makes you pay more than necessary.
Do I Need a Lawyer to File a Case in Abu Dhabi?
The law allows individuals to file their own claims in many situations, but the court does not correct a claimant’s case, and an opponent who hires a lawyer will build a defence on every gap in your statement of claim.
Before instructing anyone, check their registration through the Search for a Lawyer service on the Abu Dhabi Judicial Department website, since pleading before its courts is limited to registered lawyers, and a typing office that files the case for you bears no responsibility for its drafting. Fees are set once the type, value and stage of the case are known, and are fixed in a written agreement before work begins.
